These Terms & Conditions (“Terms”) form a legally binding agreement between you (“User”, “You”) and HyTechSMS (referred to as “HyTechSMS”, “We”, “Our”, or “Us”), governing your access to and use of all services provided through hytechsms.com, including messaging services, APIs, and related products.

By accessing or using HyTechSMS services, you confirm that you have read, understood, and agreed to these Terms. These Terms are governed by and construed in accordance with the laws of the Republic of India.
All electronic notices and communications shall be deemed valid and legally received once electronically delivered.

1. Service Usage Policy

You agree to comply with all applicable local, national, and international laws, regulations, and telecom guidelines while using HyTechSMS services. You are solely responsible for all activities carried out through your account, including message content and recipient data.

1.1 Prohibited Use

You must not use HyTechSMS services for any illegal, unethical, or unauthorized purpose, including but not limited to:

  • Sending messages containing sexual, obscene, abusive, hateful, defamatory, discriminatory, or harassing content

  • Sending unsolicited messages (spam)

  • Promoting alcohol, gambling, dating services, or deceptive/fraudulent offers

  • Collecting or using personal data without proper consent

  • Misrepresenting your identity or impersonating any individual or organization

  • Sharing unlawful, vulgar, or objectionable material

  • Violating intellectual property rights

  • Transmitting malware, viruses, or harmful code

  • Attempting unauthorized access to systems or networks

  • Engaging in any activity that may result in civil or criminal liability for HyTechSMS

You are fully responsible for all messages sent through your account. HyTechSMS does not review or control message content and assumes no liability for it.

2. Message Delivery & Service Availability

SMS delivery is dependent on telecom operators and network conditions. Successful delivery may be affected by factors such as:

  • Recipient network availability

  • Device status or memory capacity

  • Operator routing and restrictions

HyTechSMS does not guarantee delivery time, delivery success, sender ID availability, or uninterrupted service operation.

Messages that fail to deliver within their validity period may be discarded by the telecom operator without notice. Transmission logs maintained by HyTechSMS shall be considered accurate and final.

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials. Any activity performed through your account will be deemed authorized by you. HyTechSMS shall not be liable for unauthorized use resulting from compromised credentials.

4. Credits, Billing & Refund Policy

  • SMS credits are non-refundable and non-transferable

  • Credits do not earn interest

  • All credits must be used within the validity period specified at the time of purchase

  • Undelivered messages are not eligible for refunds

HyTechSMS reserves the right to modify pricing, credit validity, and billing structures at any time.

5. Suspension & Termination

HyTechSMS reserves the right, at its sole discretion, to suspend or terminate your account without prior notice if you violate these Terms, applicable laws, or regulatory guidelines.

  • Suspension or termination does not release you from obligations already incurred

  • Remaining credits may be forfeited as per the no-refund policy

  • HyTechSMS is not obligated to retain your data or credits after termination

You may terminate your account at any time by providing written notice via email. Upon termination, access to services and remaining credits will be revoked.

6. Limitation of Liability

HyTechSMS provides its services on an “as is” and “as available” basis, without warranties of any kind, express or implied.

We do not guarantee:

  • Error-free or uninterrupted service

  • Accuracy or completeness of delivery reports

  • Availability of sender IDs

HyTechSMS, its affiliates, employees, and partners shall not be liable for:

  • Service interruptions or delays

  • Message delivery failures

  • Direct, indirect, incidental, or consequential damages

  • Loss of data, revenue, or business

SMS messages are transmitted without encryption and may be intercepted. Users should avoid sharing sensitive information via SMS.

7. Indemnification

You agree to indemnify and hold harmless HyTechSMS, its directors, officers, employees, and partners from any claims, damages, losses, liabilities, or expenses arising from:

  • Your use of the service

  • Violation of these Terms

  • Any content transmitted through your account

8. Modification of Terms

HyTechSMS reserves the right to update or modify these Terms at any time. Continued use of the service after changes are posted constitutes acceptance of the revised Terms.

If you do not agree with the updated Terms, you must discontinue use of the services and terminate your account.

9. Regulatory Compliance

These Terms are subject to modification in accordance with:

  • TRAI regulations

  • Applicable telecom laws

  • Government of India policies

Any conflict between these Terms and regulatory requirements shall be resolved in favor of applicable law.

10. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Courts located in India shall have exclusive jurisdiction over any disputes arising under these Terms.
